TUPE for life

TUPE . IS FOR LIFE!



I would like to take this opportunity to explain in plain and simple terms for anybody that is unsure about the conditions regards TUPE and your rights as being transferred to a new employer,taken from the actual document here is what is says and i quote.

"It must be remembered that other elements of employment law continue to apply to contracts in the context of a TUPE transfer.Therefore an employer can not validly impose new terms and conditions without the agreement of the employees.Any changes would have to be agreed by the employee or by his union representatives on his behalf".

NOW my point is clear,the difficulties we face are pressures from our employer in that they want us to agree or sign documents that state we are willing to undertake these conditions,and that our unions are agreing things on our behalf!!!! . i therefore suggest people do not sign anything your employer wants you to,also that you make clear that the unions cannot agree a change in your terms/conditions without consultation with you....simple! :)

    The worrying thing is the Unions don't seem to be fighting/shouting hard enough..........the relationship that has been forged between the Employers & Unions, termed a 'Partnership' seems a very unhealthy situation to be in and one has to wonder if representation of Union Members is not being compromised !

Yes i agree ,the only time we hear of the union in our sector is when they have apparently agreed to something,even though we have never been consulted or balloted ...its all part of a plan!! and just to hold staff etc back from creating issues...the new health and social care bill is all the goverment want to pass through to finally have given away the NHS...to private companies who will make millions and the nhs will go downhill,this is already happening everywhere...so called not for profit and private companies getting away with making millions year in and year out also avoiding taxes.
